Terms of Use

These Terms of Use are a binding agreement between you and Josh Whitman, doing business as 68Fit (“68Fit,” “we,” “us,” or “our”). They govern 68fit.com and related applications, content, features, and services (collectively, the “Service”). By using the Service or creating an account, you agree to these Terms and acknowledge our Privacy Policy and Fitness & Medical Disclaimer. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old. If you are not yet the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. We do not knowingly allow children under 13 to create accounts or submit personal information.

Provide accurate information, protect your login credentials, and notify us promptly of suspected unauthorized access. You may not impersonate another person or create an account without authorization.

2. What 68Fit provides

68Fit provides general fitness education, workout planning, exercise guidance, machine-identification assistance, location-based outdoor activity ideas, progress tools, and optional faith-based encouragement. Personalization does not make the Service medical care or professional supervision.

3. Fitness and safety

Exercise involves risk, including falls, equipment failure, strains, cardiovascular events, permanent injury, and death. Consult an appropriate healthcare professional before beginning or changing an exercise program, especially if you have a medical condition, injury, pregnancy, medication-related concern, or have been inactive.

• Choose exercises, resistance, duration, and intensity appropriate for you.
• Inspect equipment and follow manufacturer, gym, and facility instructions.
• Use qualified in-person instruction or a spotter when appropriate.
• Stop for chest pain, severe shortness of breath, faintness, confusion, sharp pain, or other concerning symptoms.
• Call 911 or the applicable emergency number when emergency help may be needed.

4. Machine photos and identification

Machine identification may be incorrect, incomplete, or based on visually similar equipment. Confirm the manufacturer and model, read all labels and instructions, inspect the equipment, and ask qualified facility staff when uncertain. Never rely solely on 68Fit to determine safe setup or operation.

Do not upload photos containing another person, a minor, private information, medical records, access credentials, or content you lack permission to share.

5. Location and outdoor activities

Suggestions may be incomplete, outdated, unavailable, or unsafe. Check access, ownership, laws, closures, traffic, terrain, weather, daylight, wildlife, cellular coverage, permits, and emergency plans yourself. Do not trespass or use location features while operating a vehicle.

6. Faith-based content

Scripture, devotionals, and encouragement are informational and inspirational. They are not medical care, crisis intervention, professional counseling, or a substitute for qualified clergy, counselors, healthcare professionals, or emergency services.

7. User content

You retain ownership of content you submit. You grant 68Fit a nonexclusive, worldwide, royalty-free license to host, store, process, transmit, and display it only as reasonably needed to operate, secure, improve, and provide the Service, comply with law, and enforce these Terms. You represent that you have the rights and permissions needed to submit your content.

8. Acceptable use

You may not misuse the Service, including by:

• using it unlawfully, deceptively, or to harm or harass another person;
• attempting unauthorized access, probing security, or interfering with operation;
• scraping, reselling, sublicensing, or commercially exploiting the Service without written authorization;
• uploading malicious, infringing, threatening, hateful, exploitative, or privacy-invasive content; or
• claiming that 68Fit medically approved, certified, or guaranteed a result.

9. Ownership and third parties

The Service, its original content, software, design, and 68Fit and 6|8 branding belong to 68Fit or its licensors. We grant you a limited, revocable, nonexclusive license for lawful personal use. Third-party services, links, trademarks, and equipment information remain controlled by their respective owners and do not imply endorsement.

10. Paid features

Before paid features begin, the price, billing period, renewal terms, trial terms, and cancellation method will be shown at purchase. Unless stated otherwise, subscriptions renew until canceled. App-store purchases are also subject to the store’s billing and refund rules. Payments are nonrefundable except where required by law or stated at purchase.

11. Service changes and termination

We may add, modify, suspend, or discontinue features and may restrict access for security, maintenance, legal compliance, nonpayment, suspected abuse, or violation of these Terms. You may stop using the Service and request account deletion at any time.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” 68FIT DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, SAFETY, AVAILABILITY, AND RESULTS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 68FIT AND ITS OWNER, CONTRACTORS, PROVIDERS, LICENSORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST DATA OR PROFITS; OR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THE SERVICE.

Total aggregate liability will not exceed the greater of the amount you paid to 68Fit during the 12 months before the claim or $100. These limits do not exclude liability that cannot legally be excluded.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless 68Fit and its owner and providers from claims and reasonable costs arising from your content, unlawful or unsafe conduct, violation of these Terms, infringement of rights, or misuse of the Service.

15. Alabama law and disputes

Alabama law governs these Terms. Before filing a claim, each party will make a good-faith effort to resolve it through written notice and 30 days of informal discussion. Where permitted, jurisdiction and venue will lie in the state or federal courts located in the Alabama county where the operator of 68Fit resides or principally conducts business.

16. Changes and general terms

We may update these Terms by posting a revised version and effective date, with additional notice when required. If a provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver.
